The history and present of the Prosecutor's Office of the Slovak Republic

Abstrakt: Prokuratúra zohráva v slovenskom právním poriadku významnú úlohu, zastupuje verejný záujem a dohliada nad dodržiavaním zákonnosti. Autorka v príspevku ponúka historický exkurz inštitútu slovenskej prokuratúry od roku 1948 po súčasnosť, v ktorom poukazuje najmä na zásadné legislatívne zmeny, ktoré sa dotkli práve tejto oblasti. Rovnako sa zaoberá jej úlohami a pôsobnosťou v súčasnosti v zmysle aktuálnej právnej úpravy, pričom pozornosť upriamuje na monopol diskrečnej právomoci prokurátorov.

Abstract: The Prosecutor's Office plays an important role in the Slovak legal system, representing the public interest and supervising compliance with the law. In the article, the author offers a historical excursion of the prosecutor's office from 1948 to the present, in which she points out mainly the fundamental legislative changes that affected this area. It also deals with its tasks and scope at present in terms of the current legislation, while drawing attention to the monopoly of discretionary power of prosecutors.

Alternative sentences as substantial tools of restorative justice in the sense of the current legal situation

Abstrakt: Primárnym cieľom predmetného príspevku je predovšetkým zamerať sa na problematiku využívania a ukladania alternatívnych trestov ako hmotnoprávnych nástrojov restoratívnej justície, pretože v aplikačnej praxi sa v súčasnosti vyskytujú problémy s ich ukladaním, a to jednak z dôvodu, že súd je povinný na odôvodnenie výroku o vine a treste dokazovať aj iné dôležité okolnosti na uloženie niektorého z alternatívnych druhov trestov, ako aj z dôvodu nedostatočného množstva kontrolných, resp. technických zariadení a nedostatku probačných a mediačných úradníkov.

Abstract: The primary goal of the article in question is to focus on the issue of using and imposing alternative sentences as substantive instruments of restorative justice, because in application practice there are currently problems with their imposition, partly due to the fact that the court is obliged to justify the verdict on guilt and punishment prove also other important circumstances for the imposition of one of the alternative types of sentences, as well as an insufficient amount of control or technical facilities and lack of probation and mediation officers.

Annotation: The level of irregular migration reached unexpected numbers over 2015 and 2016. Every year, thousands if irregular migrants are ordered to leave European Union’s Member States since their stay on the European soil is illegal. The author presents a short overview of some of available legislative Acts related to Return Policy of European Union. An effective Return Policy with necessary respect of Fundamental Rights is a key element for ensuring European standards. This paper introduces relevant definitions to better understand the policy on returns, best interest of child, non-refoulment principle as well as the main priority of Member States on voluntary returns. Forced returns should be used only in last resort.

Specifics of the criminal activity of members of the security forces

Abstrakt: Príspevok sa zaoberá špecifikami trestnej činnosti príslušníkov bezpečnostných zborov. Autor popisuje využitie kriminalistiky a kriminalistickej metodiky pri odhaľovaní, preverovaní a vyšetrovaní trestnej činnosti príslušníkov bezpečnostných zborov. V ďalšej časti príspevku autor popisuje spôsoby odhaľovania, dokumentovania a možné indikátory trestnej činnosti príslušníkov bezpečnostných zborov.

Abstract: The article deals with the criminal activity of members of the security forces and its specifics. The author describes the use of criminology and criminological methodology in the detection, verification and investigation of criminal activity by members of the security forces. In the next part of the paper, the author describes methods of detection, documentation and possible indicators of criminal activity by members of the security forces.

Variants of the institutional incorporation of the inspection body

Abstrakt: Príspevok sa zaoberá analýzou možnosti inštitucionálneho začlenenia a pôsobnosti inšpekčného orgánu, resp. orgánu, ktorý plní úlohy na úseku odhaľovania, dokumentovania, objasňovania a vyšetrovania protiprávneho konania policajtov, zamestnancov ministerstva vnútra resp. príslušníkov ostatných bezpečnostných zborov, najmä v jednotlivých členských štátoch Európskej únie, resp. v ďalších vybraných štátoch.

Abstract: The paper deals with the analysis of the institutional integration and scope of the inspection body or the body that fulfills tasks in the field of revealing, documenting and clarifying the illegal actions of police officers, employees of the Ministry of the Interior or members of other security forces, especially in individual member states of the European Union, or in other selected states.

Aspects of the right to an effective investigation

Abstrakt: Príspevok sa zaoberá judikatúrou Európskeho súdu pre ľudské práva, ktorá na zabezpečenie nezávislosti a nestrannosti vyšetrovania trestnej činnosti príslušníkov bezpečnostných zborov kladie prísne a jednoznačné požiadavky, ktoré vyplývajú z jednotlivých článkov Dohovoru o ochrane ľudských práv a základných slobôd. V druhej časti príspevku analyzujeme, či súčasný systém vyšetrovania trestnej činnosti príslušníkov bezpečnostných zborov spĺňa požiadavky kladené Európskym súdom pre ľudské práva.

Abstract: The paper deals with the jurisprudence of the European Court of Human Rights, which imposes strict and unambiguous requirements to ensure the independence and impartiality of the investigation of criminal activities of members of the security forces. The impartiality and independence of the investigation follows from the individual articles of the Convention on the Protection of Human Rights and Fundamental Freedoms. In the second part of the article, we analyze whether the current system of investigating criminal activity of members of the security forces meets the requirements set by the European Court of Human Rights.

Amnesty and mercy in The legal system of The Slovak Republic

Anotácia: Právomoc udeliť amnestiu alebo milosť patrí k tradičným prerogatívam hlavy štátu, a to aj v súčasných podmienkach demokratických a právnych štátov, ktoré sú založené na princípe deľby moci, predovšetkým princípu oddelenia súdnej moci od moci zákonodarnej a výkonnej. Oprávnenie hlavy štátu udeliť amnestiu alebo milosť môžeme považovať za akýsi zásah exekutívy do súdnej moci. Historické prežívanie týchto inštitútov ma filozofické korene v uznaní skutočnosti, že tak ako nie je dokonalý človek, nie je dokonalý ani ním vytvorený právny poriadok. Cieľom tohto príspevku je preto bližšie priblížiť vývoj týchto inštitútov vo vzťahu k Ústave Slovenskej republiky, vymedziť ich základnú charakteristiku a zásadný rozdiel, trestnoprávne následky ich ukladania a v neposlednom rade poukázať aj na viaceré aplikačné problémy spájané s ich ukladaním.

Annotation: The power to grant amnesty or pardon belongs to the traditional prerogatives of the head of state, even in the current conditions of democratic and legal states, which are based on the principle of separation of powers, primarily the principle of separation of judicial power from legislative and executive power. We can consider the authority of the head of state to grant amnesty or pardon as a kind of interference by the executive in the judicial power. The historical experience of these institutes has philosophical roots in the recognition of the fact that just as man is not perfect, neither is the legal order created by him. The aim of this contribution is therefore to bring closer the development of these institutes in relation to the Constitution of the Slovak Republic, to define their basic characteristics and fundamental difference, the criminal consequences of their imposition and, last but not least, to point out several application problems associated with their imposition.

Restorative justice and the application of diversions in the conditions of the Slovak republic from the point of view of theory and practice

Abstrakt: Cieľom predmetného príspevku je predovšetkým zamerať sa na problematiku využívania odklonov ako nástrojov restoratívnej justície v prípravnom konaní, s akcentom na ich aktuálnu aplikáciu v praxi. Hlavným cieľom príspevku však nie je len didakticky zhrnúť aktuálnu teóriu a aplikačnú prax, ale v neposlednom rade aj kriticky zhodnotiť problémy týkajúce sa skúmanej problematiky.

Abstract: The aim of the article in question is to focus primarily on the issue of using diversions as tools of restorative justice in pretrial proceedings, with an emphasis on their current application in practice. Victims of crime investigated by quantitative and qualitative research

Abstrakt: cieľom predmetného príspevku je analýza vybraných kvantitatívnych a kvalitatívnych údajov o obetiach kriminality v podmienkach Slovenskej republiky. Účelom je snaha o zlepšenie situácie v oblasti pomoci obetiam kriminality, podporenej využívaním relevantných zdrojov informácií o obetiach trestných činov, akými štatistické údaje a výstupy viktimologických výskumov nepochybne sú.
