Registered partnership as an integral part of the right to private and family life

Abstrakt: Predkladaný článok ponúka prehľadovú analýzu právneho stavu v oblasti ochrany súkromného a rodinného života kohabitujúcich osôb na Slovensku. Aktuálny stav je kriticky reflektovaný z pohľadu medzinárodnoprávnych záväzkov Slovenskej republiky a regionálnych štandardov v oblasti ľudských práv. Ústrednou otázkou, na ktorú tento text hľadá odpoveď je či alebo v akom zmysle môžeme hovoriť o tom, že Slovenská republika v tejto oblasti nerešpektuje svoje ľudskoprávne záväzky. Článok poukazuje na určité zlyhania predovšetkým vo vzťahu k LGBT osobám, pre ktoré manželstvo, vzhľadom na aktuálny právny stav na Slovensku, nepredstavuje reálnu možnosť vzájomne si upraviť vzťahy a zaistiť tým úplnú právnu ochranu.

Abstract: The paper offers an introductory analysis of the legal situation in the field of protection of private and family life of cohabiting persons in Slovakia. The situation is critically reflected in terms of international legal obligations of the Slovak Republic and regional standards in the field of human rights. The central question to which the text seeks an answer is whether, or in what sense, we can legitimately say that the Slovak Republic is not respecting its human rights obligations in this area? The article points out certain failures, especially in relation to LGBT persons, for whom marriage, given the current legal situation in Slovakia, does not represent a real possibility to regulate their relationship and secure the full legal protection.

Restoration and Rehabilitation as Part of Modern Criminal Justice (Part One)

Abstrakt: Autorka v článku približuje súčasný stav tradičnej retributívnej spravodlivosti a jej limity- preťaženosť súdnictva, vedľajšiu rolu poškodeného v trestnom konaní, krízu trestu odňatia slobody, recidívu, pasívnu zodpovednosť páchateľa trestného činu a problematickú reintegráciu odsúdeného. Na tieto negatívne fenomény sa snažia nájsť riešenie alternatívne prístupy k trestnej spravodlivosti v podobe rehabilitačnej a restoratívnej justície. V prvej časti dvojdielneho príspevku sa autorka venuje historickému vývoju a praktickým problémom spojeným s prevládajúcou retributívnou, teda odplatnou spravodlivosťou a teoretickým východiskám, definícii a princípom restoratívnej justície.

Abstract: In this article the author describes the current state of traditional retributive justice and its limits - the overloaded judiciary, the secondary role of the victim in criminal proceedings, the crisis of imprisonment, recidivism, the passive responsibility of the offender and problematic reintegration of the convict. Alternative approaches to criminal justice in the form of rehabilitative and restorative justices seek to find a solution to these negative phenomena. In the first part of this two-part article, the author deals with the historical development and practical problems associated with the prevailing retributive, i.e. punishment- based justice and theoretical background, definition and principles of restorative justice.

Predložená monografia, na ktorej sa podieľali autori Michal Solárik a Filip Korček a ktorá vyšla v roku 2020 vo vydavateľstve Leges, patrí tematicky nesporne k aktuálnym témam, ktoré sú diskutované v odbornej i širšej laickej verejnosti. Obaja autori v súčasnosti pôsobia ako externí doktorandi na Katedre trestného práva a kriminológie Právnickej fakulty Trnavskej univerzity v Trnave. Obaja autori publikovali viacero vedeckých publikácii doma a aj v zahraničí a zúčastnili sa viacerých vedeckých konferencii.

Changes in the duties of drivers with an emphasis on positively influencing the traffic safety situation

Abstrakt: Autori príspevku oboznamujú čitateľa s vybranými ustanoveniami novely zákona č. 8/2009 Z. z. o cestnej premávke a o zmene a doplnení niektorých zákonov. K zmene vybraných ustanovení bolo pristúpené z dôvodu pozitívneho ovplyvnenia dopravno-bezpečnostnej situácie na cestách v Slovenskej republike. Jedným z cieľov príspevku je poukázať na zmeny týkajúce sa povinností vodičov v súvislosti s novelou zákona o cestnej premávke.

Abstract: The authors of the article acquaint the reader with selected provisions of the amendment to Act. no. 8/2009 Coll. on road traffic and on amendments to certain laws. The change of selected provisions of it was approached because of the positive effect on traffic safety on roads in the Slovak Republic. One of the aims of the paper is to point out the changes concerning the obligation of drivers in connection with the amendment to the Road Traffic Act.

The scope of selected order components at the place of violation of the protected object

Abstrakt: Autor článku svoju pozornosť venuje základnej charakteristike činnosti vybraných poriadkových zložiek, ktoré svoju pôsobnosť uplatňujú pri narušení chráneného objektu. Je veľmi dôležité zamerať sa na pozornosť vykonávania služobných zákrokov, ktoré sa realizujú v prípade narušenia chráneného objektu.

Principle of proportionality and its application to individual institutions of criminal law

Anotácia: Autorka sa v článku venuje téme zásady primeranosti a jej uplatňovanie pri jednotlivých inštitútoch trestného práva. Cieľom článku je definovanie pojmu zásady primeranosti v kontexte trestného práva a jej uplatnenie v trestnom práve hmotnom ako zásady pri ukladaní trestov páchateľovi trestného činu a v kontexte práva procesného ako zásade priamo definovanej v §2 ods. 2 Trestného poriadku a uplatňovanie vo viacerých procesných inštitútoch ako napr. inštitút predvolania, predvedenia a zabezpečenie svedka, príkazu na zatknutie, vydanie a odňatie veci, osobnej a domovej prehliadke.

Anootation: In this article, the author deals with the topic of the principle of proportionality and its application in individual institutes of criminal law. The aim of the article to define the concept of proportionality in the context of criminal law and its application in substantive criminal law as a principle in imposing penalties on the offender and in the context of procedural law as a principle directly defined in §2 para. 2 of the Criminal Procedure Code and application in several procedural institutes such as institute of summoning, showing and securing a witness, arrest warrant, extradition and seizure, personal and house search.

Usability of latent finger prints

Abstrakt: Príspevok je zameraný na psychologické a externé faktory ovplyvňujúce rozhodovanie expertov o upotrebiteľnosti daktyloskopických stôp. Cieľom je identifikácia najčastejšie vyskytujúcich sa chýb pri vyhodnocovaní daktyloskopických stôp vznikajúcich v procese daktyloskopickej identifikácie v dôsledku objektívnych, externých faktorov a zlyhania ľudského faktora. Text sa zaoberá nasledovnými otázkami: proces daktyloskopickej identifikácie osôb, upotrebiteľnosť daktyloskopických stôp, faktory ovplyvňujúce rozhodovanie expertov o upotrebiteľnosti stôp.

Abstract: The article focuses on the psychological and external factors influencing the expert decisions on usability of latent prints in fingerprint examination. It aims to identify the most common errors in fingerprint examination as a results of both objective, external factors as well as psychological factors in the process of fingerprint identification. The article is aimed at the following questions: the proces of fingerprint identification, usability of latent prints, factors affecting the expert decisions on usability of latent prints.

Modern technologies and purpose of their use

Abstrakt: Vedecká štúdia je zameraná na vlastný výskum autora, ktorý bol realizovaný prostredníctvom dotazovania respondentov z prostredia Policajného zboru, iných štátnych inštitúcií a tiež súkromného sektora. V rámci prezentácie čiastkových výsledkov výskumu sa v tejto publikácií autor venuje najmä účelu využívania moderných technológií užívateľmi pri práci a ich často nebezpečným zvykom. Tento príspevok vznikol v rámci riešenia čiastkovej úlohy „Internet vecí“, vedeckovýskumnej úlohy VÝSK. 245¹, evidovanej na Akadémií Policajného zboru v Bratislave.

Legal nature of administrative expulsion of an alien

Abstrakt: Administratívne vyhostenie je rozhodnutie o tom, že cudzinec nemá alebo stratil oprávnenie na pobyt s možnosťou uložiť mu zákaz vstupu. Právna povaha uvedeného inštitútu je daná širokým spektrom právnych úprav na úrovni medzinárodnej, európskej a vnútroštátnej. Cieľom článku je rozobrať predmetnú úpravu na všetkých uvedených rovinách a dospieť k záveru o právnej povahe administratívneho vyhostenia.

Abstract: Administrative expulsion is a decision that an alien does not have or has lost the right of residence with the possibility of imposing a ban of entry on him. A wide range of legal regulations at the international, European and national levels gives the legal nature of this institute. The aim of the article is to analyze the regulation in question at all the above levels and to conclude on the legal nature of administrative deportation.

Analysis, comparison and synthesis of knowledge to increase the quality of information systems for Fire and Rescue Corps of the Slovak republic

Abstrakt: Cieľom článku je analyzovať informačné systémy Hasičského a záchranného zboru (HaZZ) na podporu riadenia. Ide hlavne o charakteristiku jednotlivých informačných systémov využívaných HaZZ pri zásahu a po zásahu a ich následnú analýzu z hľadiska faktorov ovplyvňujúcich ich kvalitu a účinnosť. V prvom rade bolo hodnotenie miesta a úloh informačných systémov v riadení HaZZ z hľadiska právnej úpravy v Slovenskej republike. Riešil sa informačný systém a systém riadenia HaZZ pri zásahu – databáza výjazdov a zásahovej činnosti hasičských jednotiek HaZZ; štruktúra databáz a ich informačná skladba; databanka nebezpečných látok Alfadat EP 5.1; Nebis - Alarm 101, ako aj informačný systém a systém riadenia HaZZ po zásahu – program STAT ZPP jeho pôvod, pojmy, obsahovú náplň zameranú na získavanie informácií, selekciu získaných informácií, aregáciu informácií a prácu s odvodenými informáciami, nedostatky v činnosti programového vybavenia, spracovanie odborného posudku k príčine vzniku požiarov, zvýšenie komfortu a bezpečnosti, obsahový rozsah jednotlivých číselníkov. V závere je návrh opatrení a odporúčaní do bezpečnostnej.

Abstract: The aim of the article is to analyse the information systems of the Fire and Rescue Service (HaZZ) to support management. This is mainly the characteristics of individual information systems used by HaZZ during and after the intervention and their subsequent analysis in terms of factors affecting their quality and effectiveness. First and foremost was the evaluation of the place and tasks of information systems in the management of HaZZ in terms of legislation in the Slovak Republic. The information system and the management system of the HaZZ in case of intervention were solved - the database of exits and intervention activities of the HaZZ fire brigade units; database structure and their information composition; Dangerous Substances Database Alfadat EP 5.1; Nebis - Alarm 101, as well as information system and management system HaZZ after intervention - STAT ZPP program its origin, concepts, content aimed at obtaining information, selection of information obtained, information retrieval and work with derived information, deficiencies in software operation , elaboration of expert opinion on the cause of fires, increase of comfort and safety, content range of individual code lists. Finally, there is a proposal of measures and recommendations to the security.
